Fatal Hermosa Beach foreclosure lawsuit in court March 18

A Torrance Courthouse judge on Thursday set March 18 as the next hearing date in the case of the late Larry Delassus versus Wachovia Mortgage-Wells Fargo. Delassus died in court Dec. 19 of cardiac arrest while his attorney argued against a tentative ruling in favor of the bank. Delassus had maintained that foreclosing on his Hermosa Beach home and selling it at auction was the result of a bank error.

Delassus’s attorney, Anthony Trujillo, told Judge Laura Ellison on Thursday that he is without a plaintiff until the trustee of Delassus’s estate is finalized in probate court, which can take up to 60 days. Ellison is scheduled to determine whether to allow the lawsuit seeking punitive damages to proceed to trial or not.
