Counts dropped in city lawsuit by three Hermosa police officers

A judge has dismissed most of the complaints in a lawsuit by three Hermosa police officers who claim their rights were violated in the city’s handling of disciplinary matters.

City Attorney Michael Jenkins called the ruling a win for the city, while Corey Glave, attorney for the officers, said the judge’s ruling let stand the officers’ most serious allegations.

In the lawsuit, officers Donavan Sellan, Scott Kansaku and David Bohacik claimed that city officials refused to provide them with administrative appeals to the state Civil Service Board following disciplinary actions, such as negative comments made in writing, which would remain in their personnel files.

Kansaku is no longer with the department.

Superior Court Judge Michael P. Vicencia dismissed all allegations by Kansaku, stating in a written order that the officer had raised “no triable issues” in any of his allegations.

In the case of Sellan, the judge dismissed six complaints, including allegations that he was improperly denied personnel documents, and that officials took “punitive action” when he was denied a promotion and an assignment to the job of watch commander.

In the case of Bohacik, the judge dismissed four complaints, including allegations that officials improperly denied him documents and special police assignments.

The judge let stand complaints by Sellan and Bohacik that they were illegally denied administrative appeals following disciplinary actions. The officers claim those actions can affect the likelihood of promotions or special assignments for officers. ER

    A sincere thank you Judge Vicencia for sticking up for us Hermosa Beach taxpayers. We are tired of constantly being sued by the same officers (Sellan has an ongoing federal lawsuit against Hermosa Beach). They give the good HBPD officers a bad name. Bohacik & Sellan’s gripe that being disciplined could have a bad affect on the “likelihood of promotions or special assignments” is laughable; better than a Dr. Vu skit on Saturday Night Live. Neither of these two has the skills or knowledge to be a sargeant or watch commander. Those spots have already been filled by qualified HBPD officers. With any luck, Mr. Burrell will have the city fight the remaining complaints in court before a jury. That way when the jury finds us innocent and gives them a big fat $0, the city can go after Sellan and Bohacik for all the legal costs. Now that would be justice!

    Well Ace I think my SNL skits are prety funny, but I got to agree with you when it comes to HBPD cops Bohacik and Sellan. These two former Marriot hotel security guards are plain lucky anybody ever gave them a badge and gun. It’s down right scary if ya ask me. But I agree and say let’s fight them in front of a jury. From what I’ve read and heard, jurors don’t believe a word they say. And if we can make them pay us back after we the citizens of hermosa beach kick their butts in court, even better!

    So happy to see the judge saw Sellan and Bohacik’s lawsuit for what it is; straight-up extortion. They must need the extra cash to cover foreclosures, supplements or kung fu equipment. But what’s really pathetic is their lawyer. A few years ago he ran for the Hermosa Board of Education and said he cared soooo much for our city and kids. Now when he keeps slamming Hermosa with bogus lawsuits on behalf of disgruntled cops, it just looks like sour grapes. Mr. Glave has an ax to grind with with Hermosa’s electorate because he resoundedly lost the election and now he seeks his revenge. So I guess the old adage is true, birds of feather flock together.

    I may not live there but I’m sure LASO, if given the chance, can patrol Hermosa Beach as good as you are getting now for 1/2 the cost. We already do on July 4th, New Years Eve and at other events you have. Give us a chance for a year. If you are not happy go back to having your own police force.

    These officers and their lawyer are a bunch of self serving bozos. They only want to take money from deep pockets Hermosa Beach. Do they wonder why when people like me get stuck on jury duty why I vote to let the people they arrested off? It’s simple. I used to believe the police told the truth and sacraficed for the good of the people. Now I don’t believe a word that comes out of any officer’s mouth because I realize too many of them are only out for themselves.
